Welcome to Rapture Clouds (“Rapture Clouds,” “we,” “our,” or “us”), a multimedia streaming radio, livestreaming, entertainment, music, educational, and digital media platform operated by DLHERO LLC, ENTH3 LLC, and affiliated entities organized and/or administered under applicable laws of the State of Wyoming and the United States.

These Terms of Service & Use Agreement (“Terms”) govern your access to and use of:

  • raptureclouds.com,
  • affiliated domains and subdomains,
  • livestreams,
  • radio streams,
  • archived broadcasts,
  • mobile experiences,
  • applications,
  • social/community spaces,
  • chat systems,
  • Discord servers,
  • embedded media,
  • podcasts,
  • downloads,
  • APIs,
  • and all related digital services (collectively, the “Services”).

BY:

  • ACCESSING THE WEBSITE,
  • STREAMING AUDIO OR VIDEO,
  • SUBMITTING CONTENT,
  • PARTICIPATING IN CHATS,
  • EMAILING PLATFORM REPRESENTATIVES,
  • USING CONTACT FORMS,
  • JOINING COMMUNITY SPACES,
  • OR OTHERWISE INTERACTING WITH THE SERVICES,

YOU ACKNOWLEDGE THAT:

“Content” means all:

  • music,
  • audio,
  • livestreams,
  • DJ sets,
  • broadcasts,
  • podcasts,
  • videos,
  • graphics,
  • text,
  • AI-generated media,
  • logos,
  • metadata,
  • archives,
  • branding,
  • and creative works.

“User” means any person or entity accessing or using the Services.

“Contributor” means DJs, artists, guests, moderators, hosts, collaborators, sponsors, or submitters.

“User Content” means submissions, uploads, messages, comments, demos, artwork, recordings, or other materials provided by users.

“Third-Party Services” means platforms including but not limited to:

  • Twitch,
  • YouTube,
  • Spotify,
  • Discord,
  • Apple Music,
  • TikTok,
  • Instagram,
  • Mixcloud,
  • SoundCloud,
  • Google,
  • Bandcamp,
  • and similar providers.

3. ELIGIBILITY & AGE REQUIREMENTS

You must be at least thirteen (13) years old to use the Services.

Certain content, livestreams, discussions, events, or materials may be intended only for:

  • adults,
  • users 18+,
  • or users 21+ depending on jurisdiction.

By using the Services, you represent that:

  • you possess legal capacity,
  • your use complies with applicable laws,
  • and you are legally permitted to access the Services within your jurisdiction.

4. ENTERTAINMENT, COMMENTARY & EDUCATIONAL PURPOSES

Rapture Clouds is an entertainment, commentary, artistic, educational, and multimedia platform.

The Services may contain:

  • satire,
  • parody,
  • opinion,
  • political commentary,
  • spiritual discussion,

  • playback compatibility,
  • stream quality,
  • monetization eligibility,
  • metadata accuracy,
  • or permanent accessibility.

Streams, playlists, broadcasts, schedules, archives, and content may be modified, interrupted, suspended, or removed at any time without notice or liability.

6. PRIVACY POLICY & DATA COLLECTION

We may collect:

  • IP addresses,
  • browser/device information,
  • analytics information,
  • streaming/player activity,
  • community interactions,
  • email communications,
  • and voluntarily submitted information.

Moderation decisions are final.

9. CYBERSECURITY, PLATFORM PROTECTION & UNAUTHORIZED ACCESS

Unauthorized activities are strictly prohibited, including:

  • scraping,
  • reverse engineering,
  • dataset harvesting,
  • AI training extraction,
  • credential attacks,
  • malware deployment,
  • phishing,
  • API abuse,
  • webhook abuse,
  • metadata harvesting,
  • stream hijacking,
  • denial-of-service attacks,
  • vulnerability exploitation,
  • unauthorized automation,
  • database extraction,
  • or intellectual property theft.

Unauthorized access attempts may violate:

  • civil laws,
  • criminal statutes,
  • cybersecurity regulations,
  • and intellectual property protections.

Rapture Clouds reserves the right to:

  • monitor systems,
  • preserve logs,
  • investigate incidents,
  • cooperate with cybersecurity investigators,
  • refer incidents to legal authorities,
  • and pursue civil or criminal remedies.

10. VERIFIED SUBMISSIONS POLICY

Submissions should include:

  • verified artist links,
  • official social media profiles,
  • lawful contact information,
  • DSP links,
  • and ownership information where applicable.

Users may not:

  • impersonate artists,
  • submit malicious links,
  • disguise ownership,
  • use deceptive redirects,
  • or submit fraudulent materials.

Anonymous or suspicious submissions may be rejected or removed.

11. FAIR USE, COMMENTARY & THIRD-PARTY MATERIALS

Certain content may involve:

  • commentary,
  • transformative edits,
  • educational analysis,
  • satire,
  • public-domain materials,
  • reviews,
  • reactions,
  • and fair-use discussions.

Nothing within the Services waives:

  • copyrights,
  • trademarks,
  • publicity rights,
  • or intellectual property protections.

Contributors remain individually responsible for submitted materials.

We reserve the right to:

  • remove disputed materials,
  • comply with takedown requests,
  • preserve evidence,
  • and cooperate with lawful investigations.

12. MUSIC, PLAYLISTS & DJ LIABILITY

Contributors, DJs, hosts, and playlist curators represent and warrant that they possess lawful authority or necessary permissions for submitted or broadcast content.

Rapture Clouds does not guarantee:

  • copyright immunity,
  • monetization eligibility,
  • or uninterrupted access on third-party services.

Contributors remain responsible for:

  • samples,
  • remixes,
  • playlists,
  • stems,
  • and licensing compliance.

13. INTELLECTUAL PROPERTY RIGHTS

All Content is owned or licensed by:

  • DLHERO LLC,
  • ENTH3 LLC,
  • contributors,
  • licensors,
  • or affiliated creators.

Protected material includes:

  • music,
  • streams,
  • archives,
  • videos,
  • graphics,
  • logos,
  • branding,
  • visualizers,
  • AI-generated works,
  • metadata,
  • software,
  • and broadcasts.

Except where expressly permitted, users may not:

  • reproduce,
  • scrape,
  • rebroadcast,
  • redistribute,
  • archive,
  • download,
  • clone,
  • train AI systems upon,
  • modify,
  • or commercially exploit Content.

All rights not expressly granted are reserved.

14. AI-GENERATED CONTENT & SYNTHETIC MEDIA

The Services may utilize:

  • AI-generated visuals,
  • AI-assisted music,
  • synthetic voices,
  • automated editing,
  • voice modeling,
  • and generative systems.

Users may not:

  • clone voices,
  • reproduce AI models,
  • scrape datasets,
  • impersonate contributors,
  • or train external AI systems using Service content without written authorization.

AI-assisted works remain protected intellectual property where legally applicable.

15. USER CONTENT & MUSIC SUBMISSIONS

By submitting:

  • demos,
  • recordings,
  • artwork,
  • comments,
  • mixes,
  • or other materials,

you represent that:

  • you possess necessary rights,
  • your submissions are lawful,
  • and your materials do not infringe third-party rights.

You grant Rapture Clouds a non-exclusive worldwide license to:

  • stream,
  • archive,
  • distribute,
  • display,
  • promote,
  • edit,
  • and rebroadcast submitted materials.

Submission does not guarantee:

  • publication,
  • payment,
  • promotion,
  • or continued availability.

16. GUEST DJ & CONTRIBUTOR TERMS

Contributors remain independent participants and are not employees, partners, or agents of Rapture Clouds.

Participation grants Rapture Clouds rights to:

  • record,
  • archive,
  • replay,
  • distribute,
  • promote,
  • edit,
  • and monetize contributor performances where legally permitted.

17. LIVESTREAM RELEASE WAIVER

Participation in livestreams, interviews, recordings, broadcasts, or media productions constitutes consent to:

  • recording,
  • livestreaming,
  • editing,
  • replay archives,
  • and promotional usage.

Participants grant perpetual rights to use:

  • likeness,
  • image,
  • voice,
  • performance,
  • and statements
    for lawful promotional, commercial, educational, and archival purposes.

18. CANNABIS, AGE & CULTURAL DISCLAIMER

The Services may contain:

  • cannabis-related discussions,
  • hemp commentary,
  • KANEH references,
  • spiritual discussion,
  • satire,
  • artistic expression,
  • or educational content.

Nothing constitutes:

  • medical advice,
  • legal advice,
  • or encouragement of unlawful conduct.

Users remain solely responsible for compliance with local laws.

19. THIRD-PARTY SERVICES

The Services may integrate with:

  • Twitch,
  • YouTube,
  • Spotify,
  • Discord,
  • TikTok,

Third-party services maintain separate policies and terms.

We are not responsible for:

  • suspensions,
  • platform behavior,
  • or third-party data handling.

20. SPONSORSHIPS & AFFILIATE DISCLOSURES

The Services may include:

  • sponsored content,
  • affiliate links,
  • promotional partnerships,
  • advertisements,
  • or compensated endorsements.

Compensation may occur through:

  • sponsorships,
  • affiliate commissions,
  • partnerships,
  • merchandise,
  • and related arrangements.

21. DMCA & COPYRIGHT POLICY

Copyright notices should be submitted to:

We reserve the right to:

  • remove allegedly infringing materials,
  • suspend repeat infringers,
  • preserve evidence,
  • and cooperate with lawful authorities.

22. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED:
“AS IS,”
“WITH ALL FAULTS,”
AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM:

  • WARRANTIES OF MERCHANTABILITY,
  • FITNESS FOR A PARTICULAR PURPOSE,
  • NON-INFRINGEMENT,
  • SECURITY,
  • ACCURACY,
  • AVAILABILITY,
  • AND ERROR-FREE OPERATION.

USE OF THE SERVICES IS ENTIRELY VOLUNTARY AND AT YOUR OWN RISK.

23. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

DLHERO LLC, ENTH3 LLC, CONTRIBUTORS, HOSTS, DJs, AFFILIATES, LICENSORS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES,
  • CONSEQUENTIAL DAMAGES,
  • LOST PROFITS,
  • BUSINESS INTERRUPTION,
  • REPUTATIONAL HARM,
  • LOST DATA,
  • OR EMOTIONAL DISTRESS.

TOTAL LIABILITY SHALL NOT EXCEED:
THE GREATER OF:
(A) ONE UNITED STATES DOLLAR ($1.00 USD),
OR
(B) THE TOTAL AMOUNT PAID BY USER TO THE SERVICES DURING THE PRECEDING TWELVE (12) MONTHS.

Certain jurisdictions may not allow certain limitations.

24. INDEMNIFICATION

Users agree to defend, indemnify, and hold harmless:

  • DLHERO LLC,
  • ENTH3 LLC,
  • contributors,
  • DJs,
  • licensors,
  • affiliates,
  • contractors,
  • and employees
    from claims arising from:
  • user conduct,
  • submitted content,
  • violations of law,
  • or breaches of these Terms.

25. BINDING ARBITRATION

ALL DISPUTES SHALL BE RESOLVED EXCLUSIVELY THROUGH CONFIDENTIAL BINDING ARBITRATION.

Arbitration shall:

  • occur under applicable arbitration rules,
  • be conducted in English,
  • and proceed under applicable federal and Wyoming law.

Users waive:

  • jury trial rights,
  • class actions,
  • representative proceedings,
  • collective claims,
  • and mass arbitration participation.

The arbitrator may award only:

  • actual direct damages,
  • and legally required equitable relief.

Punitive or consequential damages are prohibited where permitted by law.

To the maximum extent permitted by law:

  • prevailing parties may seek reasonable legal fees and arbitration costs,
  • and frivolous or abusive claims may result in sanctions.

26. CLASS ACTION WAIVER

Users agree disputes may proceed only individually.

Participation in:

  • class actions,
  • collective litigation,
  • representative proceedings,
  • or mass arbitration claims
    is expressly waived.

27. TERMINATION

These Terms are governed by:

    without regard to conflict-of-law principles.

We may modify these Terms at any time.

Updated Terms become effective upon posting.

Continued use of the Services constitutes acceptance of revised Terms.
